Officer charged with assaulting black jaywalking suspect in N. Carolina

This incident again highlights the impunity under which police agencies operate in the United States, where 1,192 people were murdered by the police last year and this year another 228 as of March 7, an average of more than three killings every day.

RALEIGH, N.C. A white police officer whose body camera recorded him beating a black pedestrian he accused of jaywalking has been arrested on assault charges in North Carolina. Hickman first told the trainee to write him a ticket, but then told Rush to put his hands behind his back after Rush complained that officers didn't have anything better to do than "harass somebody" for walking.

Prior to the Thursday announcement, the City of Asheville had filed a petition to have the body camera footage released.

Although the beating occurred in August, the public was not informed of the incident until a source provided the body camera footage to the Citizen Times this week. Police Chief Tammy Hooper also confirmed Wednesday that Hickman was no longer with the department.

The camera footage also shows Hickman hitting Rush on the head over and over with a closed fist, and Rush crying out in pain as he is shocked with a Taser.

In the ensuring altercation, Hickman is seen repeatedly punching Rush in the face, as Rush says, "I can't breathe".

On Sept. 15, 2017, Buncombe County District Attorney Todd Williams dropped all charges against Rush.

Police cleared the scene during that investigation and then received reports of shots fired in the area. That teen was also arrested Tuesday .

Hickman has been released after posting $10,000 bond and declined to a respond to a reporter while walking out of jail, the Citizen-Times reports. Rush briefly appears to indicate that he'll cooperate before fleeing from Hickman on foot. He said 58 hours of footage was reviewed and "revealed four other instances where Hickman displayed discourteous and rude conduct to members of the public". Kapoor, who just took office in January after being the top vote-getter in last year's election, said in a statement that the release of a video showing a then-Asheville police officer beating an unarmed black man last August and the revelations of the delays in investigating it were "clearly a setback" in changing the culture of the police department, he still supports Hooper.

Asheville police finished an administrative probe in December, concluding that Hickman should be fired.

City Councilwoman Sheneika Smith told the New York Times that she recognized Rush from her work with the nonprofit Green Opportunities, which provides job training. The charges detailed Thursday night against Hickman - who resigned from the police force in January - are one count each of assault by strangulation, assault inflicting serious injury, and communicating threats. Hooper made a decision to terminate him in January, personnel records show, but before she could deliver the news, he notified the department of his resignation, the documents say.

"Asheville has an issue where we place value on certain people and we devalue other people based on their race, their politics, their economic situation or their placement within Asheville", Smith said.
